Today a bill was introduced in the South Dakota Legislature proposing an amendment to the South Dakota Constitution banning gay marriage. It would also such render invalid such things as civil unions and domestic partnerships.
The measure appears assured of passage, being sponsored by 56 of 70 House members and 23 of 35 Senate members. While I do not personally support the concept, I do believe this is something the voters of South Dakota have the right to decide. My dispute with Thune (see below) is this is a matter for state control, not something the federal constitution need address.
The rights of the minority should never be subject to a majority vote.
